Residents are facing the unthinkable: the threat of losing their home unexpectedly. According to residents like Genece Wilson from the Lamplighter Inn, life has become a daily struggle filled with anxiety. “Every day we wake up, we gotta worry about somebody knocking on the door demanding you to get out,” she said, highlighting the overwhelming fear that has swept through the community. Frustratingly, many residents have reported that they haven’t been given any official notice about the change in ownership or the impending evictions.

The Legal Landscape

Attorneys from Legal Aid of North Carolina are stepping in to offer support for those facing eviction, hoping to assist residents in keeping eviction filings off their records and ensuring that their legal rights are upheld. “When a new owner comes in and takes over a property, whether it’s a hotel or an apartment complex, they are required to provide certain notices to the tenants in order to have them removed from the property,” explained Justin Tucker, a Charlotte Housing Manager for Legal Aid NC.

The situation isn’t equal across the board; while Tanglewood residents received a 30-day eviction notice posted on their doors, residents at the Lamplighter Inn have reportedly received no formal notifications at all. This has raised red flags regarding the legality of these evictions. Many times, landlords are not familiar with the complex state laws surrounding evictions and, as a result, attempt what are known as self-help evictions. These actions can include disconnecting key cards, turning off utilities, and even changing the locks to a tenant’s door—all of which are illegal in North Carolina.

Legal Rights at Risk

Tucker emphasizes that landlords must follow a formal court process when attempting to evict someone. “Any time a landlord wants to get a tenant out of the property, they have to go through the court process,” he said firmly. If tenants feel they are facing an illegal eviction, they can reach out to Legal Aid or file a complaint at the county courthouse. When filing a complaint, tenants can request a temporary restraining order to halt any self-help eviction actions from their landlords.

Yet, despite these legal avenues, the grim reality is that holding landlords accountable can be difficult. As Tucker points out, “Unfortunately, the landlord could get off completely scot free.” It’s a frustrating cycle for those already grappling with the anxiety of potential homelessness.

To assist the residents coping with these drastic changes, a crisis team has been deployed to the Tanglewood Apartments, and advocacy groups are mobilizing resources to help individuals at the Lamplighter Inn.
