Desmond’s Short Time in Jail

Desmond was only in the juvenile section of the jail for less than 24 hours before his untimely death. He had been charged with murder and had shown signs of a declining mental state since his arrest on November 5, 2020. In the weeks leading to his death, he was on and off suicide alert. On the day he died, he had written a final note, expressing his sorrow and referencing a lyric from an artist he admired.

Weller, rather than rushing to save Desmond, spent nearly 40 minutes outside the cell area, visible in the footage as he scribbled in a notebook.

Neglected Rounds and Policies

According to North Carolina law, deputies are required to check on inmates every ten minutes, especially those on suicide watch. They are supposed to fill out an observation log to prove these checks were performed, but evidence suggests that these policies were not followed in Desmond’s case. Weller himself admitted during a civil lawsuit deposition that he was back-filling blank entries in the logs, a move that violates both state and jail policy.

As Desmond’s condition worsened, the documentation of his supervision slipped further behind. Weller’s logs had several entries that did not align with the timestamps provided by video surveillance. This lapse in supervision not only contributed to a failure in the system but also raised questions about the competency and accountability of the jail staff
